Welcome to GhostPixel. These Terms and Conditions ("Terms") govern your access to and use of the GhostPixel website, ghostpixel.ai, and our visitor identification and automated email outreach platform (collectively, the "Service").

GhostPixel provides a software-as-a-service (SaaS) platform that allows businesses (our "Customers") to identify anonymous website visitors and automatically send personalized follow-up emails.
The Service involves installing a tracking pixel on the Customer’s website, which matches visitor data against our proprietary identity database to provide actionable leads, including names, email addresses, and phone numbers.
## 2. Account Registration and Security
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during the registration process.
- Maintain and promptly update your account information to keep it accurate, current, and complete.
- Maintain the security and confidentiality of your login credentials.
- Accept responsibility for all activities that occur under your account.
You must notify us immediately of any breach of security or unauthorized use of your account.
## 3. Customer Obligations and Compliance
As a Customer using the GhostPixel Service, you agree to the following:
### A. Lawful Use
You will use the Service only for lawful purposes and in accordance with these Terms. You agree not to use the Service in any way that violates any applicable federal, state, local, or international law or regulation, including, without limitation, any laws regarding the export of data or software to and from the United States or other countries.
### B. Privacy Compliance
You are solely responsible for ensuring that your use of the GhostPixel tracking pixel and the data collected through it complies with all applicable privacy laws, including but not limited to the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), and the CAN-SPAM Act.
You must maintain a legally compliant Privacy Policy on your website that clearly discloses:
- The use of third-party tracking technologies, including the GhostPixel pixel.
- The collection of visitor data for identification and marketing purposes.
- How visitors can opt out of such tracking and data collection.
### C. Email Marketing Compliance
When using GhostPixel to send automated emails, you must ensure that all communications comply with applicable anti-spam laws. You are responsible for managing opt-outs and unsubscribe requests promptly.
## 4. Intellectual Property Rights
The Service and its original content, features, and functionality are and will remain the exclusive property of GhostPixel and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries.
Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of GhostPixel.
## 5. Fees and Payment
Certain aspects of the Service may be provided for a fee or other charge. If you elect to use paid aspects of the Service, you agree to the pricing and payment terms presented to you at the time of purchase or as outlined in your specific agreement with GhostPixel.
We may add new services for additional fees and charges, or amend fees and charges for existing services, at any time in our sole discretion.
## 6. Limitation of Liability
To the fullest extent permitted by law, GhostPixel and its directors, employees, partners, agents, suppliers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including, without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Service.
- Any conduct or content of any third party on the Service.
- Any content obtained from the Service.
- Unauthorized access to, use of, or alteration of your transmissions or content.
## 7. Disclaimer of Warranties
Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
GhostPixel does not warrant that:
- The Service will function uninterrupted, secure, or available at any particular time or location.
- Any errors or defects will be corrected.
- The Service is free of viruses or other harmful components.
- The results of using the Service will meet your requirements.
## 8. Termination
We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, in our sole discretion, for any reason whatsoever, including, without limitation, a breach of these Terms.
If you wish to terminate your account, you may simply discontinue using the Service.
## 9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of these Terms will remain in effect.
## 10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, you are no longer authorized to use the Service.
